HOW ECUITY EDGE LLC HANDLES PRIVATE DATA

Your privacy is important to us. To better protect your privacy we provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used. To make this notice easy to find, we make it available on our homepage and at every point where personally identifiable information may be requested.

THE INFORMATION WE COLLECT

Ecuity Edge may also collect data from your licensed software or subscriptions when errors are reported. The data is only used to troubleshoot and correct the reported problem; all error and transaction logs are purged every 45 days.

THE WAY WE USE INFORMATION

We use the information you provide about yourself / others when placing an order only to facilitate the sales process. We do not share this information with outside parties except to the extent necessary to complete that order.

We use return email addresses to answer the email we receive. Such addresses are not used for any other purpose and are not shared with outside parties.

We use the information you provide about yourself / others when opening a support request only to facilitate the support process. We do not share this information with third parties except to the extent necessary to facilitate the support process. Ecuity Edge will never share your information with third parties for the support process without your consent. The information that may share will be limited to relevant information only, including technical diagnostic details.

We use non-identifying and aggregate information to better design our website, but we do not disclose anything that could be used to identify visitors to our site or applications.

Ecuity Edge does utilize third party tools to track visitor activities on our website. These tools utilize cookies to provide Ecuity Edge with information about your name, IP address, company name, and related geographical information construed from your IP address. Ecuity Edge does not submit your information to these services so any information you provide to Ecuity Edge remains with Ecuity Edge. Ecuity Edge is the sole controller of your personal data gathered by our own first party cookies. Ecuity Edge uses all gathered information to tailor the website experience to the user, advertise our product, and to facilitate the sales process.

Finally, we never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses. To limit the use and disclosure of your personal information, you may opt-out by submitting a request to privacy@ecuityedge.com.

Ecuity Edge may be required to disclose personal information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements.

Ecuity Edge’s accountability for personal data that it receives under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, Ecuity Edge remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless Ecuity Edge proves that it is not responsible for the event giving rise to the damage.

HOW YOU CAN ACCESS OR CORRECT YOUR INFORMATION

Ecuity Edge acknowledges that individuals have the right to access the personal information that we maintain about them. You may email Ecuity Edge at privacy@ecuityedge.com to request all your personally identifiable information that we collect online. You may correct factual errors in your personally identifiable information by sending us a request that credibly shows error. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections.

EU-US PRIVACY SHIELD & US-SWISS SAFE HARBOR

Ecuity Edge complies with the EU-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries. Ecuity Edge has certified that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability. If there is any conflict between the policies in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Ecuity Edge complies with the US-Swiss Safe Harbor Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from Switzerland. Ecuity Edge has certified that it adheres to the Safe Harbor Privacy Principles of notice, choice, onward transfer, security, data integrity, access, and enforcement. If there is any conflict between the policies in this privacy policy and the Safe Harbor Privacy Principles, the Safe Harbor Privacy Principles shall govern. The US Federal Trade Commission has jurisdiction over Ecuity Edge’s compliance with the EU-US Privacy Shield and Ecuity Edge is subject to the investigatory and enforcement powers of the US Federal Trade Commission.

In compliance with the EU-US Privacy Shield Principles and US-Swiss Safe Harbor Principles, Ecuity Edge commits to resolve complaints about your privacy and our collection or use of your personal information. European Union or Swiss citizens with inquiries or complaints regarding this privacy policy should first contact Ecuity Edge at privacy@ecuityedge.com.

Ecuity Edge has further committed to refer unresolved privacy complaints under the EU-US Privacy Shield Principles BBB EU PRIVACY SHIELD, a non-profit alternative dispute resolution provider located in the United States and operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint.

Please note that if your complaint is not resolved through these channels, under limited circumstances, a binding arbitration option may be available before a Privacy Shield Panel.
